Article 1 - Preamble
The conditions of use below are applicable exclusively between La Boutique en ligne de l'Orchestre Philharmonique de Monte-Carlo and anyone visiting or making a purchase via the boutique.opmc.mc or the www.opmc.mc website.
Internet users have access to the conditions of use on the boutique.opmc.mc website. Given that the conditions of use may be modified, the applicable conditions of use are effective at the date a purchase is made.
Article 2 - Contract
2.1 Applicable conditions for placing an order
La Boutique en ligne de l'Orchestre Philharmonique de Monte-Carlo does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use La Boutique en ligne de l'Orchestre Philharmonique de Monte-Carlo only with the involvement of a parent or guardian.
2.2 Ordering
Once you have placed an order we will send you a confirmation email. We will inform you when your order has been shipped.
Article 3 - Price, availability, delivery
The prices are displayed in euros, and include french taxes (french VAT and other applicable taxes), and exclude handling and shipping fees.
We will accept orders when products are in stock. Stock availability information is available on the page related to the product.
We will always endeavour to keep the stock information up to date, however, in the unlikely event that a product should not be in stock, we will inform you as soon as possible.
Should a product not be in stock, and should we not be in a position to provide you with a product similar in quality and price, your order will be cancelled automatically and your credit card would be credited to the value of the products which we were unable to provide.
Your credit card will be billed at time of order. Therefore, should a product not be in stock, and no replacement could be delivered to you, your credit card would be billed back with the amount of your purchase.
In spite of our best efforts, there could be a pricing error on one of the numerous products displayed on our website. However, you can be assured that we will always verify prices during our delivery process.
Article 4 - Customs
Orders placed via the website for delivery outside of France and Monaco could be subject to taxes and customs upon arrival to the parcel's country of destination. It is your responsibility to ensure that these taxes and customs are paid. We are not under the obligation to check or inform you of applicable taxes and customs. We recommend that you check with your country's authorities in order to check the procedure and rules.
Article 5 - Payment
Products may only be purchased with a credit card.
Cards issued outside of France or Monaco must be international credit cards..
Article 6 - Returning Goods
Please refer to our returns policy which applies to the goods sold on our website.
As per our returns policy, you are entitled to a 30 day period to return goods purchased on our website. You also benefit from a 7 day "cooling off" period where you can return goods, without having to give us a reason.
In the unlikely event that a non-standard product be delivered to you, please refer back to our returns policy. Should we accept to replace a damaged product, or a non-standard product, you must return it within 30 days following our intent to replace the product. Should you not abide by this 30 day rule, we reserve the right to debit the credit card used to make the purchase with an amount equivalent to the value of the product (including VAT) which you have failed to return to us.
Article 7 - Ownership of goods
Delivered goods will remain our property until they have been paid for and handed over to the shipping company.
Article 8 - Guarantee and responsibility
You are legally protected against product defects.
We cannot be held responsible if a delivered product doesn´t comply with the legislation of the country of delivery, except France and Monaco.
We will do our utmost to offer the best service to our customers. However, we will not be held responsible should our contractual obligations not be met due to situations of "force majeure" as defined by the Monegasque jurisdiction.
We will not be held responsible for delays in shipping should our editors or providers be out of stock. Additionally, we will not be held responsible for slight differences on the photos, texts or illustrations of the products displayed on our website and the products shipped.
We will do our utmost to ensure that the contents of our conditions of sale will be met at all times. We shall be responsible for any direct and predictable damage at the time of use of the website, or at the time the contract is signed between you and us. However, we shall not be held responsible for any loss of benefits, commercial loss, data loss or any other indirect damage which was not predictable at the time of use of our website, or at the time the contract is signed between you and us.
The above paragraph becomes unapplicable in case of misrepresentation or gross error on our part, in case of physical damage caused by product defects, in case of non compliance of products.

You are granted a limited license to access and use our website. You cannot download or modify all or part of the website without our written authorisation. This license does not enable you to use, for sale or commercial purposes, either the website or its content (listed products, description, prices or copy of the information for the use of another seller, use of data, graphics, images, texts, photographies or tools).

The conditions of use are subjected to the monégasque law, and to the Vienna Convention related to international sales of goods. All disputes arising between you and us will be handled by Monegasque jurisdiction.
